Chapter 138 of the Laws of 2023 amends the Education Law to allow certain registered nurses (RNs), licensed practical nurses (LPNs) and physicians (MD or DO) licensed and in good standing in another U.S. state or territory to practice while their application for licensure is under review by the Department. This temporary practice is only authorized for 180 days, or 10 days after notification that the applicant does not meet the qualifications for licensure, whichever shall occur first. Additionally, the authorization period cannot be renewed or extended. The deadline to apply for temporary practice authorization has now passed, as applications must have been submitted within 30 days of the effective date of Chapter 138 (June 22, 2023), but qualified licensure applicants who applied can be verified using the Department’s Verification Search under Permittee Name.
