The New York State Education Department (“SED”) Office of the Professions (“OP”) is alerting everyone to a vishing scam that has been brought to our attention. Phishing—or “vishing”—scams impersonate SED employees or websites attempting to collect licensure and personal information from the licensee. If you receive an inquiry which you believe to be suspicious do not provide any information. To verify if the inquiry was from OP, contact us directly. You may report any suspicious communication received to the Federal Trade Commission.

Yes. Effective October 7, 2025, a prescription for a non-controlled substance including any remaining authorized refills, may be transferred from one pharmacy to another at the express request and approval of the patient or the patient’s authorized representative.

Yes.  Effective April 14, 2026, a prescription for a controlled substance may be transferred to and filled by another pharmacy subject to the requirements of Article 33 of the Public Health Law and Part 80 of Title 10 of the New York Codes of Rules and Regulations.

No. Effective October 7, 2025, prescriptions for non-controlled substances, must be transferred in full, including all refills, at the time of the transfer.

A prescription may only be transferred between two licensed pharmacists or by a pharmacy intern working under the direct supervision of a licensed pharmacist upon the express request and approval of the patient or their authorized representative.

No.  Prescription transfer information can only be communicated between two licensed pharmacists or by a pharmacy intern under the direct supervision of a licensed pharmacist.

Yes.  A pharmacist may initiate a prescription transfer only after receiving an express request and authorization from the patient or the patient’s authorized representative.
